Terms and Conditions

1. Scope

These Terms and Conditions apply to events held in the restaurant, in the event spaces of the hotel and the museum, to the outdoor facilities, to room reservations, and to all other related services and supplies.



2. Conclusion of the Contract

The contract is concluded upon confirmation by Burg Reichenstein GmbH & Co. KG. Burg Reichenstein GmbH & Co. KG is free to confirm the booking in writing.


3. Services

Reserved rooms or event spaces are available to the guest/customer only during the agreed-upon time. Use of the rooms beyond the specified time period requires prior arrangement.

Burg Reichenstein GmbH & Co. KG reserves the right to make changes to the rooms, provided that such changes are reasonable for the guest/customer, taking into account the interests of Burg Reichenstein GmbH & Co. KG.

This applies in particular to events planned to be held outdoors. In such cases, Burg Reichenstein GmbH & Co. KG is responsible for deciding whether the event can take place 24 hours prior to the event.


4. Cancellation Policy for Reservations of Guest Rooms and/or Event Spaces

In the event of cancellation of a reservation for guest rooms and/or event spaces, cancellation fees are generally payable. The basis for calculating the cancellation fees is the contractually agreed menu price and/or room rate and/or package rate. In the event of cancellation of rooms reserved on a binding basis as part of a group booking, cancellation of rooms associated with an event (notwithstanding Section 5), or cancellation of a rented room:


  • Once the contract is signed, 20% of the agreed price is due.
  • Up to 12 weeks before the arrival date, 60% of the agreed price is due.
  • Up to 4 weeks before the arrival date, 80% of the agreed price is due.
  • If cancellation occurs less than one week before the arrival date, 100% of the agreed price will be charged.

In the event of cancellation of a confirmed reservation for an individual booking:

  • There are no cancellation fees if you cancel up to 7 days before your arrival date.
  • If cancellation occurs less than 7 days before the arrival date, 80% of the agreed price will be charged.

In all of the above cases, the following applies: If the rooms are rebooked, no cancellation fees will be charged. The guest or person making the reservation is free to provide evidence that the expenses saved were higher in the specific case.

Burg Reichenstein GmbH & Co. KG reserves the right to demonstrate that the savings are lower.


5. Cancellation of individual rooms associated with an event

Individual rooms (up to three) associated with an event for which 10 or more rooms have been booked may be canceled free of charge up to 7 days before the event begins.


6. Cancellation Policy for Reservations for In-House Events

The following applies to cancellations of reservations for in-house events:

 

  • Up to 6 weeks before the event: no cancellation fees apply;
  • Up to 4 weeks before the event: 50% of the agreed price is due;
  • Up to 14 days before the event: 80% of the agreed price is due;
  • On the day before the event and on the day of the event: 100% of the agreed price is due;

The deduction of saved expenses is accounted for on a flat-rate basis. The organizer is free to provide evidence that the aforementioned claim did not arise or did not arise in the amount claimed.

If the booking is transferred to another party, no cancellation fees will apply.


7. Down payment

Burg Reichenstein GmbH & Co. KG is entitled to request a down payment of 20% from the organizer upon conclusion of the contract and 90% of the agreed total service fee up to 7 days before the event.


8. Set-off

The guest/customer may only set off a claim against the hotel if the claim is undisputed or has been finally adjudicated.


9. Withdrawal

Burg Reichenstein GmbH & Co. KG is entitled to terminate the contract for a valid reason, for example, if

 

  • if it has reason to believe that the event may jeopardize the smooth operation of the business, safety, or the company’s public reputation, without this being attributable to the control or organizational sphere of Burg Reichenstein GmbH & Co. KG;
  • force majeure or circumstances beyond the control of Burg Reichenstein GmbH & Co. KG render performance of the contract impossible;
  • Events are booked based on misleading or false information regarding key facts about the organizer or the purpose of the event
  • the purpose or occasion of the event is unlawful

10. Duty to Provide Information, Notification of the Number of People


a) Group travel

To ensure that room or group bookings for 10 or more people run smoothly, the guest or person making the reservation must provide the hotel with a complete list of names no later than 7 days before the group’s arrival.

 

b) Seminars, events, and celebrations

The organizer must provide the final number of attendees, which will serve as the basis for calculation, in writing no later than 7 days before the event. Based on this, the following applies:

 

  • Any change in the number of participants exceeding 5% must be reported to Burg Reichenstein GmbH & Co. KG no later than 7 business days before the start of the event and requires the company’s approval.
  • If the actual number of participants is higher than expected, the actual number will be billed.
  • If the number of participants deviates by more than 10%, Burg Reichenstein GmbH & Co. KG is entitled to recalculate the agreed prices and to change the confirmed rooms, unless this would be unreasonable for the organizer. In the event of a corresponding downward deviation, Burg Reichenstein GmbH & Co. KG is alternatively entitled to withdraw from the contract.

11. Minimum sales

Our wedding packages are available for groups of 60 or more adults on Fridays and 80 or more adults on Saturdays from April through October. If the celebration involves fewer guests,

The minimum sales requirement of EUR 15,900.00 on a Friday and EUR 21,200.00 on a Saturday still applies. The minimum sales requirement applies to food and beverages.


12. Service fee for an event you have organized

In the interest of our staff, we charge an hourly night surcharge of €550, including staff hours, from midnight until 2:00 a.m.
From 2:00 a.m. until 3:00 a.m. at the latest, we charge a night surcharge of €1,200, including staff hours.


13. Bringing Your Own Food and Beverages

As a general rule, the organizer may not bring food or beverages to events. In special cases (such as national specialties), the contracting parties may agree to an exception in writing.

In such cases, a service charge or corkage fee may be charged.


14. Construction Activities

Due to the nature of the site at Reichenstein Castle, construction work may occur from time to time, which may result in disruptions inside and outside the castle, as well as in the restaurant and hotel buildings.

No definitive statements can be made regarding the timeframe for these activities.


15. Due Date

We request that the invoice be paid in full, without any deductions, to the account listed below within seven days of receipt.


16. DamagesCompensation

a) The guest/booker is liable for any damage to or loss of furnishings or inventory that occurs during a stay, with the rebuttable presumption that such damage or loss was caused by or attributable to event participants. The display of decorative materials or other objects is not permitted without the hotel’s consent. The hotel assumes no liability for damage to or loss of items or exhibits brought onto the premises, except in cases of intent or gross negligence. Any necessary insurance for items brought onto the premises is the responsibility of the guest/customer.

All decorative materials brought to the venue must comply with fire safety regulations.

 

b) The guest must treat the hotel’s facilities and the rooms with care and, in particular, avoid causing significant soiling or damage. In the event of damage to the room furnishings caused by at least negligence or in the event of excessive soiling, the hotel reserves the right to claim damages from the guest in the amount of 15% of the daily room rate to cover the additional cleaning and restoration costs, including any loss of revenue. This amount shall be reduced if the guest can prove that the damage was less severe.

It shall be set at a higher amount if Burg Reichenstein GmbH & Co. KG can demonstrate that the damages are greater.


17. Price Clause

If the consumer price index for Germany published by the Federal Statistical Office (based on 2010 = 100) changes by at least 10 percent compared to the index published for the month in which the contract was concluded, either party may request an adjustment of the price. The basis for such an adjustment shall be the change in the index, provided this is equitable. The price adjustment takes effect upon the request for adjustment. A price increase is invalid as of the 20th day prior to the agreed date of performance. If the requested price increase exceeds 8 percent, the organizer may offer the price increase and require the customer to either accept it within a specified period or withdraw from the contract. A price increase is excluded if the service is to be provided within four months of the conclusion of the contract.

18. Final Provisions

If any provision of this contract is invalid or unenforceable, or becomes invalid or unenforceable after the contract is concluded, the validity of the remainder of the contract shall remain unaffected.

The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects most closely approximate the economic objective that the contracting parties sought to achieve with the invalid or unenforceable provision. The foregoing provisions shall apply mutatis mutandis in the event that the contract is found to contain a gap.
